Notice is hereby given to the general public that applications involving the properties/and or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Zoning Administrator will hold a PUBLIC HEARING on these items and on other matters on Wednesday, June 26, 2019, beginning at 9:30 a.m. in City Hall, 1 Dr. Carlton B. Goodlett Place, Room 408.
CONSENT CALENDAR
Case No. 2019-000663VAR (ALEXANDRA KIRBY) - 9 FALLON PLACE, Lot 025 in Assessor's Block 0951 in a RH-2 (Residential - House, Two Family) Zoning District and a 40-X Height and Bulk District. REAR YARD VARIANCE SOUGHT: The project proposes to construct a rear horizontal addition at a depth of 6 feet 6 inches at the rear of the third story, above the existing footprint of the building to accommodate additional habitable space. PLANNING CODE PER SECTION 134 requires the subject property to maintain a rear yard of 15 feet. The proposed rear addition would be constructed entirely within the required rear yard. Therefore, the project requires a rear yard variance.
Case. 2017-013347VAR (ASHLEY WOODS) - 1702 CHURCH STREET, Lot 001 in Assessor's Block 6632 in a NC-1 (Neighborhood Commercial Cluster) Zoning District and a 40-X Height and Bulk District. OPEN SPACE VARIANCE SOUGHT: The proposal is to convert the rear portion of the second floor dwelling unit into a separate dwelling unit of approximately 335 square feet. No change to the exterior of the building is proposed. PLANNING CODE SECTION 135 requires a minimum amount of private or common useable open space be provided for each dwelling unit. The existing building covers the entire lot, there is no useable open space on the property, and no new open space will be created by the project. Therefore, the project requires a variance.
Case No. 2019-001867VAR (NANCY TRAN) - 8 PHOENIX TERRACE, Lot 029 in Assessor's Block 0182 in a RM-3 (Residential-Mixed, Medium Density) Zoning District and a 65-A Height and Bulk District.REAR YARD VARIANCE SOUGHT: The proposal is to reconstruct a first floor storage room, legalize an approximately 45 square-foot second floor deck, reconfigure exterior stairs, and enclose a third floor sunroom within the required rear yard. PLANNING CODE SECTION 134 requires a rear yard of 15 feet. The project proposes to construct the additions on a noncomplying building that encroaches into the required rear yard. Therefore, a variance is required.

Case No. 2018-008228VAR (CHRISTOPHER TOWNES) - 3207 MARKET STREET, Lot 015 in Assessor's Block 2703 in a RH-2 (Residential House, Two-Family) Zoning District and a 40-X Height and Bulk District.REAR YARD VARIANCE SOUGHT: The proposal is a horizontal rear addition to an existing single family home and a detached 1-story, 11-foot tall, 99 square-foot accessory building (tea house) within the rear yard. PLANNING CODE PER SECTION 134 requires the subject property to maintain a minimum rear yard of 25% of the lot depth (or approximately 33 feet). The tea house would encroach nearly 25 feet into the required yard and be more than 8 feet in height. Therefore, the project requires a Variance.
Case No. 2018-004363VAR (ELLA SAMONSKY) - 217 VIRGINIA STREET, Lot 019 in Assessor's Block 5617 in a RH-2 (Residential- House, Two-Family) Zoning District and a 40-X Height and Bulk District. REAR YARD VARIANCE SOUGHT: The proposal is to legalize a single-story, rear addition at the ground floor of an existing three-story building containing six dwelling units. PLANNING CODE PER SECTION 134 requires the subject property to maintain a rear yard of 35 feet 8 inches in depth. The proposed rear addition is located entirely within the required rear yard. Therefore, the project requires a rear yard variance.
Case No. 2017-007673VAR (ESMERALDA JARDINES) - 731 RHODE ISLAND STREET, Lot 015 in Assessor's Block 4072 in a RH-2 (Residential-House, Two-Family) Zoning District and a 40-X Height and Bulk District. REAR YARD VARIANCE SOUGHT: The proposal is to construct a 102-square foot horizontal addition at the second floor to provide a laundry area, closet, and a utility closet. The horizontal addition will extend into the required rear yard of the lot, which is developed with a three-story, single-family dwelling entirely within the required rear yard as well as a two-story garage along Rhode Island Street. The proposed horizontal addition measuring approximately 11 feet 2 inches wide, by 7 feet 4 inches deep (beyond the existing building wall), and 9 feet above grade will extend the existing second floor. PLANNING CODE SECTION 134 requires a rear yard area in an RH-2 Zoning District to be equivalent to 45 percent of the total lot depth. The subject property, with a lot depth of approximately 100 feet, has a required rear yard of approximately 45 feet. The proposed horizontal addition will extend approximately 2 feet into the required rear yard. Therefore, a variance is required.
Case No. 2018-009883VAR (JEFFREY HORN) - 573 DIAMOND STREET, Lot 021 in Assessor's Block 2803 in a Residential-House, Two Family (RH-2) Zoning District and a 40-X Height and Bulk District. REAR YARD VARIANCE SOUGHT: The proposal is to construct a one-story vertical addition and a 21 foot 7 inch deep horizontal rear addition to the existing single-family home. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of approximately 47 feet 3 inches. The proposed addition will encroach into the required rear yard by 16 feet. Therefore, the project requires a rear yard variance.
Case No. 2017-011142VAR (MICHAEL CHRISTENSEN) - 620 PRECITA AVENUE, Lot 030 in Assessor's Block 5514 in a RH-2 (Residential-House, Two-Family) Zoning District and a 40-X Height and Bulk District. REAR YARD VARIANCE SOUGHT: The project proposes to alter and expand a legal, non-conforming structure and dwelling unit located fully within the rear yard of the property, converting the ground floor to habitable space and adding a roof deck. PLANNING CODE SECTION 242 requires the property maintain a rear yard equal to 67.5 feet. The existing structure that will be expanded is completely within the required rear yard. Therefore, a rear yard variance is required.
Case No. 2018-016896VAR (XINYU LIANG) - 776 CAROLINA STREET, Lot 11 in Assessor's Block 4096 in a RH-2 (Residential House, Two Family) Zoning District and a 40-X Height and Bulk District. REAR YARD VARIANCE SOUGHT: The project proposes interior alterations to add an elevator and to enlarge the existing garage in the basement, as well as a horizontal addition by enclosing a rear deck for a sun room on the third floor and a new spiral stairs in the rear. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of approximately 39 feet with a two-story permitted obstruction that is setback five feet from the property lines. Portions of the proposed rear addition and the new spiral stairs will encroach into the required rear yard and result in a rear yard of 32 feet 6 inches. Therefore, the project requires a rear yard variance.
