Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Zoning Administrator intends to hold a PUBLIC HEARING on these items and on other matters on Wednesday, September 22, 2021, beginning at 9:30 a.m. or later. Please be advised that due to the COVID-19 emergency, the Zoning Administrator may conduct this hearing remotely using videoconferencing technology or in-person at City Hall. Additional information may be found on the Department’s website.

2020-004486VAR (STEPHANIE CISNEROS) 820 LAGUNA HONDA BLVD, Lot 014, Assessor's Block 2916 in an RH-1(D) Zoning Distri(ct and 40-X Height and Bulk District. REAR YARD SOUGHT: The proposal is to construct a new 178 square foot deck at the rear of the second floor. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard equivalent to 30% of the lot depth, which ranges from 23 feet 9 inches to 28 feet 7 inches for the subject property. The existing building already extends into the required rear yard. The proposed deck would project an additional 8 feet into the required rear yard. Therefore, a variance is required.

2019-017756VAR (CLAIRE FEENEY) 328 HIGHLAND AVE, Lot 035 in Assessor's Block 5717, in a RH-2 Zoning District, the Bernal Heights SUD, and a 40-X Height and Bulk District. REAR YARD SOUGHT: The proposal is to construct a vertical addition to a single-family home, adding a third floor with two roof decks, and to infill under the existing rear deck. PLANNING CODE SECTION 242 requires the subject property to maintain a rear yard equivalent to 45% of the lot depth, which is 48 feet 6 inches for the subject property. The existing building already extends into the required rear yard. The project will infill underneath the existing rear deck, which is entirely within the required rear yard. Therefore, a variance is required.

2021-003961VAR (GABRIELA PANTOJA) 540 JUNIPERO SERRA BOULEVARD,Lot 001C in Assessor's Block 7233, in a RH-1 (D) Zoning District and a 28-X Height and Bulk District. REAR YARD SOUGHT: The proposal is to legalize the construction of a one-story horizontal addition at the rear of an existing two-story, single family residence. At the first floor, the addition will be approximately 18 feet 2 inches in width and 10 feet 10 inches in depth. PLANNING CODE SECTION 134 requires the subject lot to maintain a minimum rear yard equal to 30 percent of the total lot's depth. The required rear yard for the subject property is 31 feet 6 inches. The proposed horizontal addition to be legalized will encroach 6 feet 8 inches into the required rear yard. Therefore, a variance is required.

2020-009589VAR (GABRIELA PANTOJA) 615 SANCHEZ STREET, Lot 057 in Assessor's Block 3600, in a RH-1 Zoning District, a 40-X Height and Bulk District, and Dolores Height Special Use District. REAR YARD SOUGHT: The proposal is to construct a new roof deck and exterior spiral stairs at the rear of an existing two-story over basement, single-family residence with an Accessory Dwelling Unit (ADU). The proposed roof deck will be located atop a newly created flat roof and accessed from the existing roof deck, and the proposed spiral stairs will connect the first floor and second floor terraces. PLANNING CODE SECTION 241 requires the subject lot to maintain a minimum rear yard equal to 45 percent of the total lot's depth, but in no case less than 25 feet deep. The required rear yard for the subject property is 28 feet 2 inches. The existing building encroaches at maximum 21 feet 8 inches into the required rear yard and was issued Variance No. 98.948V in 1999. The proposed spiral stair will encroach into the required rear yard. Additionally, the proposed new flat roof will expand the subject building’s envelope beyond that permitted by Variance No. 98.948V. Therefore, a variance is required.

2021-005354VAR (KIMBERLY DURANDET) 2955 HARRISON STREET, Lot 027 in Assessor's Block 4271 in an RH-2 (Residential-House, Two Family) Zoning District and a 40-X Height and Bulk District. REAR YARD SOUGHT: The proposal is to replace the existing decks and stairs at the rear of the building. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of approximately 45 feet. The existing building currently extends into the required rear yard by approximately 8 feet for an existing rear yard of 36 feet. The existing decks encroach approximately 6 feet 6 inches and the stairs 16 feet into the required rear yard. The proposed decks and stairs will encroach an additional 9 feet into the required rear yard resulting in a rear yard of 27 feet. Therefore, the project requires a rear yard variance.

2020-009279VAR (KALYANI AGNIHOTRI) 577-579 IVY STREET, Lot 015A in Assessor's Block 0806, located within an RTO (Residential Transit Oriented District) Zoning District, and a 40-X Height & Bulk District. REAR YARD SOUGHT: The proposal is to expand the existing first floor unit (#575) by converting the unhabitable basement to habitable space and add a new stair to the first floor. The project also proposes to demolish the existing rear stair and deck and build a new rear stair with decks for each unit. A new roof access stair with penthouse is proposed on the third floor (Unit #579), leading to a new roof deck. The project will add approximately 226 square feet total to the existing units. PLANNING CODE SECTION 134 requires the subject property to provide a rear yard of at least 15 feet. The existing rear yard is noncomplying, measuring approx. 13 feet 1 inch. The proposed deck and stair will extend approximately 13 feet into the required rear yard. Therefore, a variance is required.
