Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Zoning Administrator intends to hold a PUBLIC HEARING on these items and on other matters on Wednesday, August 25, 2021, beginning at 9:30 a.m. or later. Please be advised that due to the COVID-19 emergency, the Zoning Administrator may conduct this hearing remotely using videoconferencing technology or in-person at City Hall. Additional information may be found on the Department’s website.

2021-002264VAR (ELLA SAMONSKY) 157 ELLSWORTH STREET, Lot 023 in Assessor's Block 5650 in an RH-1 Zoning District, Bernal Heights Special Use District, and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to construct a rear addition of approximately 253 square feet to an existing two-story single-family residence. The project also includes an interior remodel of the residence and construction of two rear decks and a spiral staircase.  PLANNING CODE SECTION 242(e)(2) requires the subject property to maintain a rear yard of approximately 24 feet 6 inches. The proposed rear deck and spiral staircase will encroach approximately 10 feet into the required rear yard. Therefore, the project requires a variance.
                
2021-001477VAR (MONICA GIACOMUCCI) 353 PARK STREET, Lot 017 in Assessor's Block 5717, in an RH-2 Zoning District, the Bernal Heights Special Use District, and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to construct a rear addition at the first and second floors, expand a rear deck, and reconfigure a front entry stair.  PLANNING CODE SECTION 132 requires the property to maintain a front setback of 8 feet 4 inches. The proposed stair reconfiguration would fall within the required front setback. Therefore, the project requires a variance.  PLANNING CODE SECTION 242(e)(2)(B) requires the subject property to maintain a rear yard of approximately 45 feet. The proposed rear addition would result in a rear yard of approximately 25 feet. Therefore, the project requires a variance.

2014.1302V (MICHAEL CHRISTENSEN) 2906 FOLSOM STREET, Lot 001 in Assessor's Block 6525 in an RH-2 Zoning District, the Calle 24 Special Use District, and 40-X Height and Bulk District.  REAR YARD SOUGHT:  The Project proposes a four-story horizontal addition to an existing four-unit structure, including the addition of one Accessory Dwelling Unit at the ground floor.  PLANNING CODE SECTION 134 requires the subject property to provide a rear yard of nearly 21 feet. A portion of the proposed addition will be located within the required rear yard. Therefore, a variance is required.

2020-011814VAR (RYAN BALBA) 512 LISBON STREET, Lot 004 in Assessor's Block 6274 in an RH-1 Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to legalize a structure at the rear of an existing one-story over basement residential building.  PLANNING CODE SECTION 134 requires the subject property to provide a rear yard of at least 30 feet. The entirety of the structure is located within the required rear yard. Therefore, a variance is required.

2020-008529VAR (CATHLEEN CAMPBELL) 1857 CHURCH STREET, Lot 035 in Assessor's Block 6656 in an RH-2 (Residential-House, Two Family) Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The project proposes to construct a one-story over basement pop-out with 5-foot side setbacks within in the required rear yard of an existing single family home.  PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of approximately 56 feet 3 inches. A portion of the existing building currently encroaches approximately 2 feet 7 inches. The proposed addition would extend 18 feet 3 inches into the required rear yard. Therefore, the project requires a variance.

2020-007647VAR (JEFFREY SPEIRS) 134 CLIPPER STREET, Lot 012 in Assessor's Block 6549 in an RH-2 (Residential-House, Two Family) Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The project is to construct a new three-story stair at the rear of an existing three-story, three-unit building. The stair will be approximately 17 feet wide, 7 feet 2 inches deep, and 17 feet 2 inches in height. A fire wall is also proposed as part of the stair construction, with dimensions of 3 feet 8 inches in depth and 21 feet in height.  PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of approximately 47 feet 8 inches. The rear of the proposed stair would encroach approximately 17 feet 8 inches into the required rear yard, resulting in a rear yard of 30 feet. Therefore, the project requires a variance.

2020-006812VAR (CATHLEEN CAMPBELL) 1617-1619 9TH AVENUE, Lot 002 in Assessor's Block 1934 in an RH-2 (Residential-House, Two Family) Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to replace and fully enclose the rear deck at the rear.  PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard equal to 45% of the lot depth, or the average of qualifying adjacent buildings. The required rear yard for this property is approximately 49 feet 8 inches. The proposed addition will encroach approximately 12 feet into the required rear yard. Therefore, the project requires a variance.

2021-000822VAR (GABRIELA PANTOJA) 486 DUNCAN STREET, Lot 021 in Assessor's Block 6591, in an RH-2 Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to legalize the demolition and reconstruction of exterior stairs and an approximately 10 foot 10 inches by 21 feet 10 inches second-floor portion of an existing three-story, single family residence. The proposal will also construct a new third floor roof deck at the rear of the subject building. PLANNING CODE SECTION 134 requires the subject lot to maintain a minimum rear yard equal to 45 percent of the total lot's depth. The required rear yard for the subject property is 51 feet 4 inches. The exterior stairs and portion of the building to be legalized will encroach 13 feet 6 inches into the required rear yard. Therefore, a variance is required.

2020-005229VAR (CLAIRE FEENEY) 1651 TREAT AVENUE, Lot 009A in Assessor’s Block 5543 in an RH-2 Zoning District, the Bernal Heights SUD, and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The project is to construct a new single-family home on the rear of a through-lot. The new building will be 22-feet tall as measured from the Ripley Street sidewalk and will be four-stories tall on the downhill-sloping lot. The new residence will have three bedrooms, one-car parking in the garage, and a roof deck. The existing single-family home on site that faces Treat Avenue will remain as is.  PLANNING CODE SECTION 242 requires a rear yard of at least 25% of the lot depth or 15-feet, whichever is greater. The subject property is a through-lot with frontages on both Treat Avenue and Ripley Street, with Ripley Street being the rear. The proposed single-family home will be entirely within the required rear yard. Therefore, a variance is required.

2017-001125VAR (CHRIS MAY) 37 RICO WAY, Lot 048 in Assessor's Block 0439A in an RH-1 (Residential-House, One-Family) Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The project proposes horizontal infill additions on the first and second floors totaling approximately 94 square feet on the east and west sides of the previously approved but unconstructed three-story, single family dwelling. PLANNING CODE SECTION 134 was amended so that the required rear yard increased from 25% to 30% of the lot depth. The proposed 5 square-foot infill at the rear of the second floor obstructs into the required rear yard. Therefore, a variance is required.
