Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code.  The Zoning Administrator will hold a PUBLIC HEARING on these items and on other matters on Wednesday, June 23, 2021, beginning at 9:30 a.m.  Please be advised that due to the COVID-19 emergency, the Zoning Administrator will conduct this hearing remotely using videoconferencing technology. Additional information may be found on the Department's website.

2020-011184VAR (GRETEL GUNTHER) 2825 BROADWAY, Lot 014 in Assessor's Block 0963 in an RH-1(D) Zoning District and a 40-X Height and Bulk District.  SIDE YARD SOUGHT:  The project proposes to vertically extend an existing elevator at the subject property's east facade from the fourth story to the sixth story and to reduce the footprint of the existing elevator shaft from a width of approximately 15 feet to a width of 6 feet 6 inches at all street-visible levels. The elevator will retain the existing depth of projection into required side yard setback of 3 feet 4 ½ inches.  PLANNING CODE SECTION 133 requires that the side yard in an RH-1(D) Zoning District for lots with a width of 50 feet or more have two side yards each of 5 feet. The existing elevator already extends 3 feet 4 ½ inches into the required side yard setback. While the project will reduce the width of the existing obstruction into the required side yard and the overall total obstruction, the proposed vertical extension from the fourth story to the sixth story will be entirely within the required side yard. Therefore, a variance is required.

2019-020147VAR (SHARON YOUNG) 589 4TH AVENUE, Lot 022 in Assessor's Block 1547 in an RH-2 Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to raise the existing building approximately 2 feet 6 inches, construct vertical and horizontal additions, facade modifications, front and rear decks, and front dormer/bay window, plus other interior alterations. PLANNING CODE SECTION 134 requires to maintain a rear yard equal to 45 percent of the total lot depth, or the average of qualifying adjacent buildings if no less than 25 percent of the lot depth or 15 feet, whichever is greater. Any additional depth achieved through averaging is limited to a height of 30 feet. Based on averaging, the subject property has a required rear yard of approximately 36 feet.  A portion of the proposed rear additions on the second and third floors will extend approximately 8 feet into the required rear yard and approximately 2 feet of the proposed rear addition on the proposed fourth floor will exceed 30 feet at the rear of the building. Therefore, a variance is required.

2021-000503VAR (DAVID WEISSGLASS) 1035 SUTTER STREET, Lot 020 in Assessor’s Block 0301 in an RC-4 Zoning District and a 40-X Height and Bulk District.  EXPOSURE SOUGHT:  The proposal is to add 2 ADUs to an existing 34-unit building. The ADUs are proposed at the east side of the basement level of the building with windows facing onto the existing lightwell.  PLANNING CODE SECTION 140 requires all dwelling units to face directly onto a street or other open area meeting the requirement of the Planning Code. The Zoning Administrator may administratively reduce the dimensions of the open area to an area that is at least 225 square-feet with no horizontal dimension less than 9 feet for ADUs per Section 307(l)(1). The proposed ADUs face onto a lightwell that is approximately 7 feet 1 inch deep and 37 feet 1 inch wide. The depth of 7 feet 1 inch is less than the 9-foot minimum dimension required for the administrative waiver. Therefore, a variance is required.
