Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Zoning Administrator will hold a PUBLIC HEARING on these items and on other matters on Wednesday, April 28, 2021, beginning at 9:30 a.m. Please be advised that due to the COVID-19 emergency, the Zoning Administrator will conduct this hearing remotely using videoconferencing technology. Additional information may be found on the Department's website.

2020-011489VAR (ELTON WU) 173 KENSINGTON WAY, Lot 050 in Assessor's Block 2975 in RH-1(D) Zoning District and 40-X Bulk District.  REAR YARD SOUGHT: The proposal is to establish two compact off street parking spaces in the rear yard with a fence and gate as screening. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard equal to 30% of the total depth, or approximately 25 feet for this lot. PLANNING CODE SECTION 136(c)(30) clarifies that parking is not permitted in required yards. The two off street parking spaces will be located within the required rear yard. Therefore, a variance is required.

2020-010534VAR (MATHEW CHANDLER) 237-239 CHATTANOOGA STREET, Lot 024 in Assessor's Block 3649 in an RH-2 Zoning District and 40-X Height & Bulk District.  REAR YARD SOUGHT:  The project proposes a horizontal addition at the basement level, replacement and enlargement of existing, noncomplying multi-story decks with stair at the rear, and the addition of one Accessory Dwelling Unit (ADU) at the basement level per California Government Code Section 65852.2.  PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of approximately 52 feet 8 inches. The building exists as a noncomplying structure with multi-level decks and stairs extending approximately 15 feet 3 inches into the required rear yard. The reconstructed decks and stair will extend approximately 15 feet 6 inches into the required rear yard. Therefore, a variance is required.

2020-010606VAR (JOSEPH SACCHI) 345 FULTON STREET, Lot 007A in Assessor's Block 0792 in an NCT-3 Zoning District and 65-X Height and Bulk District.  EXPOSURE SOUGHT:  The project proposes the addition of four ADUs to an existing 28-unit building. One of the ADUs is proposed at the front of the existing building with glazing facing onto the street, one is proposed at the rear of the building with glazing facing onto the rear yard , and two of the proposed ADUs are proposed with glazing facing an interior court yard.  PLANNING CODE SECTION 140 requires all dwelling units to face directly onto a qualifying open area. The Zoning Administrator is allowed to grant a waiver for reduced exposure for an ADU if qualifying windows face an open area that is 1) no less than 225 square feet in size, 2) has no horizontal dimension less than 9 feet, and 3) is open to the sky with exception of permitted obstructions outlined in Section 140 . Unit #2 and Unit #3 are proposed to face a courtyard that does not meet these requirements. Therefore, a variance is required.

2021-000824VAR (ELTON WU) 8 NEBRASKA STREET, Lot 002 in Assessor's Block 5655 in RH-1 Zoning District and 40-X Bulk District.  REAR YARD SOUGHT: The proposal is to construct a rear deck on an existing two-story residential building. PLANNING CODE SECTION 242(e)(2)(A) requires the subject property to maintain a required rear yard of 45.5 feet from the front property line. The existing building is currently located in the required rear yard, and the proposed deck would be fully within the required rear yard. Therefore, a variance is required.

2019-014835VAR (MATT DITO) 3515 PACIFIC AVENUE, Lot 019 in Assessor's Block 0970, located within an RH-1 (Residential-House, One-Family) Zoning District and a 40-X Height District. FRONT YARD LANDSCAPING & PERMEABILITY, REAR YARD SOUGHT:       The proposal is to demolish a single-family dwelling and construct a replacement single-family dwelling.  PLANNING CODE SECTION 132 requires that at least 20 percent of all required front setback areas shall be landscaped, and that 50 percent of all required front setback areas shall be permeable surfaces. The permeable surface area may be inclusive of the area counted towards the landscaping requirement. The proposed single-family dwelling does not include any landscaping or permeable surfaces in the required front setback area. Therefore, a variance is required.  PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard equal to 30% of the lot depth. The subject property has a required rear yard of approximately 28 feet. The proposed single-family dwelling extends into the required rear yard. Therefore, a variance is required.

2020-003916VAR (STEPHANIE CISNEROS) 917 CAYUGA AVENUE, Lot 037 in Assessor's Block 6954 located within the RH-1 Zoning District, and a 40-X Height and Bulk District.  REAR YARD SOUGHT: The proposal is to construct a one-story, 650 square-foot, detached garage within the required rear yard. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard equal to 30% of the lot depth, which is approximately 20 feet from the rear property line. The proposed detached garage will be located within the rear yard. Therefore, a variance is required.

2020-011013VAR (RYAN BALBA) 1326-1328 DOLORES STREET, Lot 006 in Assessor's Block 6566 in an RH-3 (Residential-House, Three-Family) Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to replace existing, noncomplying rear stairs and landings and to partially remove and replace the foundation, a brick wall, and a window at the rear.  PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard equal to 45% of the lot depth or the average of the two adjacent properties. The subject property is required to provide a 45-foot 3-inch rear yard. Portions of the proposed stair and landing fall within the required rear yard. Therefore, the project requires a variance.

2020-005964VAR (RYAN BALBA) 2416 16TH AVENUE, Lot 042 in Assessor's Block 2410 in the Inner Taraval NCD Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to build a spiral stairway to an existing 2nd floor deck at the rear.  PLANNING CODE SECTION 134  requires the property to maintain a rear yard that is 25% of the lot depth but in no case less than 15 feet, whichever is greater. The proposed spiral stair falls entirely within the required rear yard. Therefore, the project requires a variance.

2020-011803VAR (MARY WOODS) 2915 BAKER STREET. Lot 006 in Assessor's Block 0940 in an RH-2 Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT:  The proposal is to construct a 4-story horizontal addition for a new elevator along the north property line within the required rear yard per a “Reasonable Modification” pursuant to Planning Code Section 305.1. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of approximately 15 feet. The proposed elevator addition will fall entirely within the required rear yard Therefore, the project requires a variance.

2020-010673VAR (SYLVIA JIMENEZ) 330 ROOSEVELT WAY, Lot 044 in Assessor's Block 2607 in an RH-2 Zoning District and a 40-X Height and Bulk District.  REAR YARD SOUGHT: The proposal is to raise the roof height of an existing kitchen at the rear of a 3-story single-family residence. PLANNING CODE SECTION 134 requires the subject property to maintain a required rear yard of 15 feet from the rear property line. The existing building, including the portion proposed to increase in height, is located in the required rear yard. Therefore, the project requires a variance.
