Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Zoning Administrator will hold a PUBLIC HEARING on these items and on other matters on Wednesday, May 24, 2023, beginning at 9:30 a.m. in City Hall, 1 Dr. Carlton B. Goodlett Place, Room 408.

2023-000804VAR (DAKOTA SPYCHER) 33-35 ALADDIN TERRACE, Lot 021B in Assessor's Block 0100, located within an RM-1 Zoning District and a 40-X Height and Bulk District: REAR YARD: The project proposes to reconstruct a three-story staircase (approximately 12 feet wide, 5 feet 5 inches deep, and extending to the roof) at the rear of the property. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of no less than 15 feet (reduced rear yard averaging). The proposed staircase will encroach entirely into the required rear yard, leaving a rear yard of 2 feet 8 inches. Therefore, the project requires a variance.

2017-003538VAR (KIMBERLY DURANDET) 2829-2847 24TH STREET (AKA 2603 BRYANT STREET), Lot 030 in Assessor’s Block 4267 in a NCT 24th-Mission (Neighborhood Commercial Transit) Zoning District and a 55-X Height and Bulk District: LOT WIDTH, REAR YARD, AND OPEN SPACE VARIANCES: The project proposed is a lot subdivision of a single parcel into three separate lots. PLANNING CODE SECTION 121 requires that parcels have a minimum width of 25 feet. The proposed subdivision will result in Parcel B with a width of 24 feet which does not meet this requirement. Therefore, a variance is required. PLANNING CODE SECTION 134 requires the subject property to maintain a required rear yard of 25%. The proposed subdivision will result in Parcel A with a lot depth of 76 feet and a required rear yard of 19 feet. As proposed the existing building would encroach into the required rear yard by approximately 7 feet leaving a rear yard of approximately 12 feet which does not meet this requirement. Therefore, a variance is required. PLANNING CODE SECTION 135 requires common open space be provided at 100 square feet per dwelling unit and be at least 15 feet in every horizontal dimension. The proposed subdivision will result in Parcel A with a common open space of approximately 12 feet in depth which does not meet this requirement. Therefore, a variance is required.

2021-010227VAR (KIMBERLY DURANDET) 507 & 507A COLE STREET, Lot 074 & 075 in Assessor’s Block 1229 in a RH-3 (Residential House- 3 Family) Zoning District and a 40-X Height and Bulk District: REAR YARD VARIANCE: The project proposes to legalize rear stairs, landings, and firewall as required. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard depth of approximately 28 feet 7 inches. The proposed structure is located within the required rear yard and leaves a rear yard of approximately 15 feet. Therefore, a variance is required.

2023-000369VAR (JEFFREY SPEIRS) 14 MOUNTVIEW COURT, Lot 004 in Assessor's Block 2822A, in a RH 1 (D) Zoning District, and 40-X Height and Bulk District: REAR YARD: The proposal is to construct a rear deck at the second story. PLANNING CODE SECTION 134 requires the subject property to maintain a rear yard of 30%, or approximately 29 feet. The new deck extends approximately 14 feet into the required rear yard. Therefore, a variance is required.

2022-012781VAR (BRANDEN GUNN) 2263 SACRAMENTO STREET, Lot 011 in Block 0638, in a RM-1 Zoning District and 40-X Height and Bulk District: REAR YARD: The proposal is to legalize the reconstruction of rear deck and stairs in the rear yard. PLANNING CODE SECTION 134 requires that the subject property maintain a rear yard of approximately 32 feet, which is 25% of the total lot depth (reduced rear yard averaging). The proposed rear deck and stairs will encroach approximately 12 feet into the required rear yard, leaving a rear yard of approximately 20 feet. Therefore, a variance is required.

2022-008197VAR (REBECCA SALGADO) 82 HARRIET STREET, Lot 109 in Assessor's Block 3731 in a MUG Zoning District, the Youth and Family Zone SUD, and a 45-X Height and Bulk District: REAR YARD: The project proposes to extend the existing three-story rear exterior stairway by an additional story to access the roof. PLANNING CODE SECTION 134 requires the subject lot to maintain a minimum rear yard equal to 25 percent of the total depth of the lot or 15 feet, whichever is greater. The required rear yard for the subject property is approximately 19 feet. The proposed extended rear stairway is fully located within the required rear yard. Therefore, a variance is required.

2022-007060VAR (BRANDEN GUNN) 10 SEACLIFF AVENUE, Lot 013A in Block 1301 in a RH-1(D) Zoning District and 40-X Height and Bulk District: REAR YARD: The proposal is to construct rear decks that projects 27 feet into the Rear Yard. PLANNING CODE SECTION 134 requires that the property maintain a 30% Rear Yard from the front property line. The proposal extends into the Rear Yard. Therefore, a variance is required.

2022-007448VAR (EDGAR OROPEZA) 1919 QUESADA AVENUE, Lots 044 and 052 in Assessor's Block 5336 in a RH-1 Zoning District, and a 40-X Height and Bulk District: REAR YARD: The project proposes a new detached deck and stairs with a maximum height of 9- feet above grade at the rear of the subject property. PLANNING CODE SECTION 134 requires that the subject lot maintain a minimum rear yard equal to 30 percent of the total lot's depth. The required rear yard for the subject property is approximately 34-feet 6 inches. The proposed deck structure will encroach approximately 29 feet 6- inches into the required rear yard. Therefore, a variance is required.

2022-008138VAR (WESLEY WONG) 382-384 LIBERTY STREET, Lots 082 and 083 in Assessor's Block 3605, in a RH-1 Zoning District, Dolores Heights Special Use District, 40-X Height and Bulk District. REAR YARD: The proposal is to replace the existing multi-story decks in the rear yard. PLANNING CODE SECTIONS 134 and 241 require the subject lot to maintain a rear yard of 25 feet, which is 45 percent of the total lot depth. The decks are an exact replacement (same location, footprint, and height) as the existing decks on the property. The decks will encroach entirely within the required rear yard and leave a rear yard of approximately 8 feet. Therefore, a variance is required.
