Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Zoning Administrator will hold a PUBLIC HEARING on these items and on other matters on Wednesday, March 27, 2024, beginning at 9:30 a.m. in City Hall, 1 Dr. Carlton B. Goodlett Place, Room 408.
2023-006880VAR (KIMBERLY DURANDET) 255 CHATTANOOGA STREET, Lot 021 in Assessor's Block 3649, in an RH-2 Zoning District, and a 40-X Height and Bulk District: REAR YARD: The proposal is to rebuild an existing garage and roof deck in-kind with a roof deck on the garage and a connection provided to the existing rear balcony of the primary building, plus a new stair from the roof deck to grade in the rear yard. PLANNING CODE SECTION 134 requires that the property maintain a rear yard that is 30% of the lot depth. The proposed reconstruction of the garage, connector, and stair is located entirely in the required rear yard. Therefore, a variance is required.
2022-008124VAR (KIMBERLY DURANDET) 118 CHATTANOOGA STREET, Lot 009 in Assessor's Block 3629, in an RH-2 Zoning District, and a 40-X Height and Bulk District: REAR YARD: The proposal is to legalize the reconstruction of a rear building as an accessory home office. PLANNING CODE SECTION 134 requires that the property maintain a rear yard that is 30% of the lot depth. The rear building is located entirely in the required rear yard. Therefore, a variance is required.
2023-011399VAR (EDGAR OROPEZA) 1512 YORK STREET, Lot 046 in Assessor's Block 5514, in an RH-2 Zoning District, Bernal Heights SUD, and a 40-X Height and Bulk District: REAR YARD: The proposal is to demolish an unauthorized deck expansion at the rear building and to construct a new deck expansion that will connect the two existing lower-level decks. PLANNING CODE SECTION 242 requires the subject property to maintain a rear yard of approximately 45 feet measured from the rear property line. The proposed deck expansion will fall entirely within the required rear yard. Therefore, a variance is required.
2019-003518VAR (DAKOTA SPYCHER) 704 NORTH POINT STREET, Lot 002 in Assessor's Block 0024, in a C-2 Zoning District, and a 40-X Height and Bulk District: REAR YARD (LOT COVERAGE): The proposal is to demolish a portion of an existing one-story commercial building and construct a new four-story mixed-use addition fronting Columbus Avenue. PLANNING CODE SECTION 134 requires no more than 80% of lot coverage at all levels containing residential uses. The proposal would result in the first and second floors covering approximately 84% of the lot. Therefore, a variance is required.
2018-001402VAR (DAKOTA SPYCHER) 1451 GREEN STREET, Lot 028 in Assessor's Block 0550, in an RH-3 Zoning District, and a 65-A Height and Bulk District: REAR YARD: The project proposes to legalize a three-story deck and stairs at the rear. The project includes a new room below the deck. PLANNING CODE SECTION 134 requires that the subject property maintain a 30% rear yard of the lot depth, approximately 23 feet. The proposal extends nearly 20 feet into the required rear yard. Therefore, a variance is required.
2024-000042VAR (KALYANI AGNIHOTRI) 217-219 HOLLY PARK CIRCLE, Lot 008 in Assessor's Block 5715, in an RH-2 Zoning District, Bernal Heights SUD, and a 40-X Height and Bulk District: REAR YARD: The proposal is to replace the existing, noncomplying exterior, rear stair with a new rear stair and deck structure. PLANNING CODE SECTION 242 requires the subject property to maintain a rear yard of approximately 45 feet measured from the rear property line. The proposed stair and deck structure will fall entirely within the required rear yard. Therefore, a variance is required.
2024-001765VAR (NICHOLAS FOSTER) 1400 MISSION STREET, Lots 820-822 in Assessor's Block 3507 and Lots 001-190 in Assessor's Block 3507A, in a C-3-G Zoning District, and a 150-S and 200-S Height and Bulk District: PUBLIC ART REMOVAL: The proposal is to remove an existing mural at the subject property fronting 10th Street due to ongoing vandalism and graffiti to the subject artwork. The on-site artwork was installed to fulfill the public art requirement for the 100% affordable housing project that was approved by the Planning Commission in 2013, through Motion 18783 (Planning Department Record 2011.1043X) Planning Code Section 429 was recently amended through Ordinance No. 003-24 to authorize the Zoning Administrator to approve the removal, relocation, or alteration of artwork previously installed pursuant to Section 429 for 100% affordable housing projects. Planning Code Section 429.4 requires the subject property to provide on-site public art of a value at least equivalent to the Public Art Fee. The proposal would remove the on-site artwork. Therefore, the project requires a duly noticed public hearing where the Zoning Administrator may approve, conditionally approve, or deny the removal, relocation, or alteration of the artwork.
