Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Planning Commission intends to hold a PUBLIC HEARING on these items and on other matters on Thursday, April 13, 2023, beginning at 10:00 a.m. or later. Please be advised that due to the COVID-19 emergency, the Planning Commission may conduct this hearing remotely using videoconferencing technology or in-person at City Hall. Additional information may be found on the Department’s website.

2022-005693PCA [Board File No. 220709] Planning Code - Nighttime Entertainment Castro Street Neighborhood Commercial District - Ordinance amending the Planning Code, to change the zoning controls in the Castro Street Neighborhood Commercial District to allow Nighttime Entertainment with a Conditional Use authorization on the second floor; and affirming the Planning Department’s determination under the California Environmental Quality Act; and making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1, and findings of public necessity, convenience, and welfare under Planning Code, Section 302. 2022-005675CUA: 429 CASTRO STREET - East side of Castro Street between 18th and 17th Streets; Lot 085 in Assessor’s Block 3582 (District 8) – Request for a Conditional Use Authorization, pursuant to Planning Code Sections 182(b), 303, and 715, to establish Nighttime Entertainment and a Bar Use on the first and second stories, alongside the existing Movie Theater Use within the existing multi-story theater building. The project includes interior and exterior alterations, including construction of a new one-story rear addition to add new dressing rooms, a restroom, and a storage platform. This Conditional Use Authorization requires a legislative amendment to the Planning Code to require a Conditional Use Authorization to establish a Nighttime Entertainment Use on the second floor within the Castro Street NCD Zoning District (See Board of Supervisors File Nos. 220709, 220862, and 221151). A Planning Commission approval at a public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). This hearing is being conducted as a joint hearing with the Historic Preservation Commission. The subject property is located within the Castro Street NCD (Neighborhood Commercial) Zoning District and a 65-B Height and Bulk District. Comments received by 9:30 a.m. on the day of the hearing will be made a part of the official record and will be brought to the attention of the Planning Commission.

Pursuant to Government Code § 65009, if you challenge, in court, the approval of a conditional use, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing.
