Instructions for Calling-In to a Meeting

  1. DIAL the number listed for the meeting toll-free at 1 (415) 655-0001.
  2. Enter the Access Code for this meeting: 187 461 8544 then press #. If prompted for an Attendee ID, just press #.
    Please note: the Access Code will change for every meeting.
  3. Stop and LISTEN.
  4. Wait for Public Comment to be announced (by Item # or for General Public Comment).
  5. When the Commission/Hearing Secretary calls Public Comment, press *3 to raise your hand.
  6. Once you raise your hand, you will hear the prompt, “You have raised your hand to ask a question. Please wait to speak until the host calls on you.” If you no longer want to submit public comment, press*3 to lower your hand.
  7. Wait for your turn to speak.
  8. When you hear the prompt, “Your line is unmuted” – THIS IS YOUR OPPORTUNITY TO PROVIDE YOUR PUBLIC COMMENT.
  9. The Commission/Hearing Secretary will indicate how much time you have to provide your comments. You will be alerted when you have 30 seconds remaining.

Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Planning Commission intends to hold a PUBLIC HEARING on these items and on other matters on Thursday, April 22, 2021, beginning at 1:00 p.m. or later, in City Hall, 1 Dr. Carlton B. Goodlett Place, Room 400.  Please be advised that due to the COVID-19 emergency, the Planning Commission may be required to conduct this hearing remotely. 2020-010729CUA: 1215 29th Avenue – west side of 29th Avenue between Lincoln Way and Irving Street, Lot 002 of Assessor’s Block 1721 (District 4) – Request for Conditional Use Authorization, pursuant to Planning Code Sections 303 and 317, to remove two Unauthorized Dwelling Units from the ground floor of an existing three-story, single-family residence.  The two Unauthorized Dwelling Units have a path to legalization under the Planning Code and are currently subject to the Rent Stabilization and Arbitration Ordinance.  Both Unauthorized Dwelling Units are currently occupied by tenants.  The Project was filed in response to the Board of Appeals’ Notice of Decision and Order in re Appeal No. 20-027 (Planning Enforcement Case No. 2018-008429ENF).  The Project Site is located within an RH-1(D) (Residential- House, One Family, Detached) Zoning District and a 40-X Height and Bulk District.  A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h).  For further information, call Vincent W. 2020-009148CUA: 353 Divisadero Street – at southwest corner of Divisadero and Oak Streets, Lot 001 of Assessor’s Block 1218 (District 5) – Request for a Conditional Use Authorization, pursuant to Planning Code Sections 202.2, 303, and 759, to establish a 1,320 square foot Cannabis Retailer on first floor of the subject property within the Divisadero Street NCT  (Neighborhood Commercial Transit) Zoning District and 40-X Height and Bulk District. A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2021-002933PCA [Board File No. 210285] – Small Business Recovery Act: Ordinance amending the Planning Code to adopt and implement the Small Business Recovery Act by, among other things: 1) expanding streamlined review and inspection procedures to principally permitted storefront uses Citywide; 2) deleting separate definitions of “Cat Boarding,” “Gym,” “Trade Shop,” and “Services, Instructional” from the Planning Code; 3) allowing permitted conditional uses to continue after three years of abandonment; 4) allowing Outdoor Activity Areas on rooftops; 5) allowing accessory catering uses in Restaurants; 6) allowing accessory dwelling units on the ground floor in Neighborhood Commercial, Chinatown Business, and Chinatown Visitor Districts; 7) allowing temporary outdoor entertainment, arts and recreation activities; 8) deleting certain conditional use finding requirements for Nighttime Entertainment use; 9) deleting conditional use findings related to formula retail concentrations in certain districts; 10) requiring expedited permit processing for commercial uses on the ground floor; 11) shortening the time for the Historic Preservation Commission to request review of minor alteration permits and certificates of appropriateness; 12) extending time for limited live performances from 10 p.m. to 11 p.m.; 13) allowing additional One-Time Entertainment Permits and One-Time Outdoor Amplified Sound Permits; 14) exempting single individual performances without amplification from permit requirements; affirming the Planning Department’s determination under the California Environmental Quality Act; and making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1, and findings of public necessity, convenience, and welfare under Planning Code, Section 302.  For further information, call Sheila Nickolopoulos at (628) 652-7442 or email at Sheila.nickolopoulos@sfgov.org and ask about Case No.2021-002933PCA.

2018-007267OFA-02: 865 Market Street – south side of Market Street at its eastern intersection with Fifth Street; Lot 042 in Assessor’s Block 3705 (District 6) - Request for the extension of an Office Development Authorization, pursuant to Planning Code Sections 321 and 322, to authorize up to 49,999 square feet from the Office Development Annual Limit. The proposed extension is for an additional two years to the previously approved Office Development Authorization. The project site is located within the Downtown Retail (C-3-R) Zoning District and the 120-X / 160-S Height and Bulk District. 2020-002333DRP: 2814 Clay Street – between Divisadero and Scott Streets; Lot 013 in Assessor’s Block 1002 (District 2) - Discretionary Review of Building Permit No. 2020.0203.3400 to construct 1- and 2-story horizontal rear additions to the existing 2-unit, three-story-over-basement building within the RH-2 (Residential-House, Two-Family) Zoning District and 40-X Height and Bulk District. The additions would increase the size of the lower unit by approximately 1,058 square feet while the upper unit would remain the same size. A roof deck measuring approximately 452 square feet above the 2-story rear addition is also proposed for exclusive use by the upper unit. No changes to the front façade are proposed This action constitutes the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). Persons who are unable to attend the scheduled Commission hearing may submit written comments regarding these cases to the individuals listed for each case above via email or at the Planning Department, 49 South Van Ness Avenue, Suite 1400, San Francisco, CA 94103. Comments received by 9:30 a.m. on the day of the hearing will be made as part of the official record and will be brought to the attention of the Commission.

Pursuant to Government Code § 65009, if you challenge, in court, the approval of a conditional use, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Commission at, or prior to, the public hearing.
