Notice is hereby given to the general public that applications involving the properties and/or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Planning Commission intends to hold a PUBLIC HEARING on these items and on other matters on Thursday, February 2, 2023, beginning at 1:00 p.m. or later. Please be advised that due to the COVID-19 emergency, the Planning Commission may conduct this hearing remotely using videoconferencing technology or in-person at City Hall. 2022-005541CUA: 855 GEARY STREET – located on the south side of Geary Street between Larkin and Hyde Streets; Lot 019 in Assessor’s Block 0320 (District 5) – Request for Conditional Use Authorization, pursuant to Planning Code Sections 209.3 and 303, to allow a change of use at the ground floor of an existing parking garage from Public Parking Garage (Automotive Use, Retail) to Fleet Charging (Automotive Use, Non-Retail) within the RC-4 Zoning District. The Project Site is located within the RC-4 (Residential-Commercial, High Density) Zoning District and 80-T Height and Bulk District and following Special Use Districts (SUD): Fringe Financial Service Restricted SUD, North of Market Residential SUD, and Group Housing SUD.A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2022-005307CUA: 3936-3938 24TH STREET – located on the north side of 24th Street between Noe and Sanchez Streets; Lots 044 and 045 in Assessor’s Block 3654 (District 8) – Request for Conditional Use Authorization, pursuant to Planning Code Sections 303, 303.1, and 728, to establish an approximately 2,440-square-foot Formula Retail use for Financial Service (d.b.a. First Republic Bank) within a ground-floor space of an existing four-story mixed-use building, within the 24th Street - Noe Valley NCD. The Project Site is located within the 24th Street – Noe Valley NCD (Neighborhood Commercial) Zoning District and 40-X Height and Bulk District and Central Neighborhoods Large Residence Special Use District. A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2022-000908CUA / 2022-000908VAR: 361 UPPER TERRACE – located on the west side of Upper Terrace; Lot 2629A in Assessor’s Block 035 (District 8) – Request for Conditional Use Authorization, pursuant to Planning Code Sections 303, 209.1, and 249.77, to increase the rear roof height on an existing legal non-complying portion of the building by approximately 3 feet. The project also proposes the construction of a rear deck that will extend approximately 19 feet into the 45% Rear Yard. A Variance from the Planning Code pursuant to Section 134 will also be required. The Project Site is located within the RH-3 (Residential-House, Three-Family) Zoning District and 40-X Height and Bulk District and Corona Heights Large Residence Special Use District. A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2022-001838CUA: 800 TARAVAL STREET – North side between 18th Avenue and 19th Avenue; Lot 009A in Assessor’s Block 2347 (District 7) – Request for Conditional Use Authorization pursuant to Planning Code Sections 202.2(a)(5), 745, and 303 to permit a Cannabis Retail Use. The proposed project (“Project”) would establish a Cannabis Retail Use (d.b.a. “Green Mirror”) measuring 977 square feet within an existing vacant, mezzanine commercial tenant space which will be converted to a new fully enclosed second floor located at the subject property. The Project does not include a request for authorization of on-site smoking or vaporizing of cannabis products. The Project proposes minor interior tenant improvements such as installing sales counters, display cases, toilets, and some interior partition walls. Aside from the installation of new accessible building entrance upgrades, new entry doors specifically for the Cannabis Retail Use, a new planter outside the existing trash enclosure door located at the northeast corner, and removal of the existing awning above that location, no other changes to the building exterior or envelope are proposed. New business signage will be applied for under a separate permit. The subject property is located within the Inner Taraval Street Neighborhood Commercial District, the Taraval Street Restaurant Subdistrict, and the Scenic Streets Special Sign District, and a 40-X Height and Bulk District. A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2022-000367DRP: 379 EUREKA STREET – between 20th and 21st Streets Lot 023 in Assessor’s Block 2750 (District 8) - Discretionary Review of Building Permit Application no. 2021.1217.4661 to construct a three-story rear horizontal addition to a 3-story, one-family dwelling within the RH-2 (Residential House - Two Family District) and 40-X Height and Bulk District. This action constitutes the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h).). It is strongly recommended that persons submit their comments in writing in advance of the hearing. Written comments may be submitted via email directly to the case planner.

Persons who are unable to attend the scheduled Commission hearing may submit written comments regarding these cases to the individuals listed for each above via email or at the Planning Department, 49 South Van Ness Avenue, Suite 1400, San Francisco, CA 94103. Comments received by 9:30 a.m. on the day of the hearing will be made a part of the official record and will be brought to the attention of the Planning Commission.

Pursuant to Government Code § 65009, if you challenge, in court, the approval of a conditional use, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing.
