Notice is hereby given to the general public that applications involving the properties/and or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code.  The Planning Commission will hold a PUBLIC HEARING on these items and on other matters on Thursday, November 21, 2019, beginning at 1:00 p.m. or later, in City Hall, 1 Dr. Carlton B. Goodlett Place, Room 400.

Case no. 2019-012970PRJ: 34 Properties Owned or Leased by The Academy of Art University -– Continued from November 7th, 2019 – The proposed Project involves 34 properties owned or leased by the Academy of Art University (The Academy). Consistent with the Term Sheet and Supplement to the Term Sheet for Global Resolution, the Project seeks to establish or legalize uses at these properties, consolidate single room occupancy units regulated under Chapter 41 of the Administrative Code into two buildings and provide at least 7 new Chapter 41 units, and perform or legalize building modifications to these properties in order to implement said uses and to generally abate all Planning Code violations. A full list of the 34 properties, site-specific zoning information and proposed uses to be considered under the Project may be found here: sfplanning.org/AAU-notice. At the public hearing, the Planning Commission will act on the following items: (1) Adoption of CEQA Findings. The Planning Commission certified the Final EIR for the Project on July 28, 2016. An Addendum to the FEIR was prepared for the Project and was published on October 9, 2019. Prior to any other action, the Commission must adopt CEQA Findings and a Statement of Overriding Considerations for the Project to proceed. (2) Planning Code Amendment and Development Agreement. The Planning Commission will adopt a resolution and recommendation to the Board of Supervisors regarding the proposed Planning Code amendments that are necessary in order to implement the Project and regarding the proposed Development Agreement between the Academy of Art University and its various LLCs and the City and County of San Francisco. (3) Master Conditional Use Authorization. As allowed by the proposed Planning Code Amendment, the Planning Commission will take action to authorize the proposed uses and building modifications across all 34 properties through a single, Master Conditional Use Authorization (MCUA). The MCUA allows the Planning Commission to grant exceptions from Code requirements that otherwise might be required under the Code to authorize all scopes of work contemplated by the Project. 2019-014224CUA: 279 Columbus Ave – on southwest side of Columbus Ave between Broadway Ave and Jack Kerouac Alley, Lot 017 of Assessor’s Block 0162 (District 3) - Request for a Conditional Use Authorization, pursuant to Planning Code Sections 303 and 714, for the new restaurant use (d.b.a. Bulgara) to operate as a restaurant with a Type-41 On-Sale Beer and Wine for Bona fide Public Eating Place license. This project was reviewed under the Community Business Priority Processing Program (CB3P). The subject property is located within the NCD (Broadway Neighborhood Commercial) and 65-A-1 Height and Bulk Districts. A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2019-017962PCA: Ordinance amending the Planning Code to require at least half of residential units in Educator Housing projects to have two or more bedrooms, to eliminate the requirement that Educator Housing projects have a minimum amount of three bedroom units, conditioned on the passage of Proposition E in the November 5, 2019, Municipal Consolidated Election; affirming the Planning Department’s determination under the California Environmental Quality Act; making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1; and adopting findings of public convenience, necessity, and welfare under Planning Code, Section 302. 2019-004849CUA:  2406 Bush Street – north side of Bush Street between Scott and Pierce Streets; Lot 004 in Assessor’s Block 0657 (District 5) - Request for Conditional Use Authorization pursuant to Planning Code Sections 303 and 317, to legalize a residential merger of two dwelling units into one dwelling unit. The proposed project would legalize the merger of two flats approximately 1,060 sq. ft. and 1,202 sq. ft. each in a two-story-over-garage residential building. The subject property is located within the RH-3 (Residential, House, Three-Family) Zoning District and 40-X Height and Bulk District. A Planning Commission approval at the public hearing would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2019-001143CUA: 1465 Donner Avenue- between Jennings and Ingalls Streets; Lot 024 in Assessor’s Block 4910 (District 10)- Request for a Conditional Use Authorization pursuant to Planning Code Section 202.2, 210.3, and 303 to establish an approximately 10,000 square foot Industrial Agriculture use at the subject property within the Production, Distribution & Repair Core (PDR-2) Zoning District and 40-X Height and Bulk District. The action constitutes the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2019-015128CUA: 333 Dolores Street- between 16th and 17th Streets; Lot 057 in Assessor’s Block 3567 (District 8)- Request for a Conditional Use Authorization pursuant to Planning Code Section 303 to amend Motion Nos. 16683 and 19041 for a request to retain three existing temporary classroom structures for an additional seven years beyond the previously approved date at the subject property within the Residential- Mixed, Low Density (RM-1) Zoning District and 40-X Height and Bulk District. The temporary classroom structures will remain at the subject property until June of 2031. No interior or exterior alterations are proposed to the existing temporary classroom structures. 2018-009157CUA  2175 Hayes Street – south side of Hayes Street between Cole and Shrader Streets; Lot 022 in Assessor’s Block 1212 (District 5) – Request for Conditional Use Authorization, pursuant to Planning Code Sections 207, 209.1, and 303, to allow the demolition of an existing one-story dental office building and new construction of a four-unit residential building with an Accessory Dwelling Unit at the ground floor. The Project proposes a dwelling unit density of one dwelling unit per 1,000 square feet within a RH-3 (Residential – House, Three Family) Zoning District and 40-X Height and Bulk District. This action constitutes the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2019-000745CUA/VAR: 1100 Thomas Avenue- intersection of Thomas Avenue and Griffith Street; Lot 001B in Assessor’s Block 4793 (District 10)- Request for a Conditional Use Authorization pursuant to Planning Code Section 202.2, 210.3, and 303 to establish an approximately 6,000 square foot Industrial Agriculture use at the subject property, including legalization of an unpermitted second floor within the existing Industrial structure, within the Production, Distribution & Repair Core (PDR-2) Zoning District and 40-X Height and Bulk District. The legalization of the unpermitted second floor within the structure reduces the height of the ground floor to less than fourteen feet, thus requiring a Variance from Planning Code Section 145.5. The action constitutes the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2018-007725DRP/VAR: 244 Douglass Street – between Caselli Ave. and 18th Street; Lot 006 in Assessor’s Block 2691 (District 8) - Request for Discretionary Review of Building Permit Application No. 2018.0820.7815 for construction of  vertical addition to an existing two-family dwelling including extensive remodeling of the interior and the modification of the rear pitched roof to a flat roof to accommodate a roof deck with planter guardrails within the RH-2 (Residential House, Two-Family) Zoning District and 40-X Height and Bulk District.  The proposal is subject to a rear-yard variance per Planning Code Section 134. This action constitutes the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). ).
