Notice is hereby given to the general public that applications involving the properties/and or issues described below have been filed with the Planning Department for review as set forth in the City Planning Code. The Planning Commission will hold a PUBLIC HEARING on these items and on other matters on Thursday, January 16, 2020, beginning at 1:00 p.m. or later, in City Hall, 1 Dr. Carlton B. Goodlett Place, Room 400.

2019-020940PCA (Board File 191075) – Residential Occupancy. Ordinance introduced by Supervisor Peskin amending the Planning Code to create the Intermediate Length Occupancy residential use characteristic. The Ordinance also amends the Administrative Code to clarify existing law regarding the enforceability of fixed-term leases in rental units covered by the just cause protections of the Residential Rent Stabilization and Arbitration Ordinance (the “Rent Ordinance”), prohibit the use of rental units for temporary occupancies by non-tenants, require landlords to disclose in advertisements for such units that the units are subject to the Rent Ordinance, and authorize enforcement through administrative and/or civil penalties; requiring the Controller to conduct a study to analyze the impacts of new Intermediate Length Occupancy units in the City; affirming the Planning Department’s determination under the California Environmental Quality Act; and making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1, and findings of public necessity, convenience, and welfare under Planning Code, Section 302. 2018-012576CUA: 1769 Lombard Street – south side of Lombard Street between Laguna and Octavia Streets; Lot 027 in Assessor’s Block 0506 (District 2). – The proposal is for Conditional Use Authorization pursuant to Planning Code Sections 303, 145.2, and 712 to authorize an Outdoor Activity Area in conjunction with a Kennel Use (d.b.a. “The Grateful Dog”) as well as a one-year review of Motion No. 20355, which authorized the Kennel Use, within the NC-3 (Neighborhood Commercial, Moderate Scale) Zoning District and a 40-X Height and Bulk District. The Project is not a project under CEQA Guidelines Sections 15060(c) and 15378 because there is no direct or indirect physical change in the environment. 2009.0159PRJ & 2019-0022891VAR: 1540 Market Street (aka “One Oak”) – located on the northwest corner of Market Street and Van Ness Avenue and bounded by Oak Street to the north; Lots 001, 002, 003, 004, and 005 in Assessor’s Block 0836 (District 5) – Request for modification to the conditions of approval pertaining to project Validity, Expiration and Renewal for the project’s Downtown Project Authorization and Conditional Use Authorization, authorized under Motion Nos. 19943 and 19944. Under the requested modification, the authorizations would be valid until June 15, 2022. The Zoning Administrator will consider Variances for exposure (Section 140) and street frontage (Section 145.1), as well as a Height Exemption for the elevator penthouse, as requested at the original time of entitlement. A modification of the conditions of approval and extension to the period of authorization for the existing entitlements is not considered a “Project” under CEQA. 2019-001455CUA: 1750 WAWONA ST – between 30th and 25th Streets; Lot 011 in Assessor’s Block 2468 (District 4) - Request for a Conditional Use Authorization pursuant to Planning Code Sections 209.1, 303 and 317 to allow the tantamount to demolition of an existing two-story single-family dwelling and legalize work exceeded beyond the scope approved under permit 201707121692 to construct a horizontal addition within the RH-1 (Residential House, Single-Family) Zoning District, a 40-X Height and Bulk District. The Conditional Use Authorization would constitute the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). 2019-005400DRP-02: 166 Parker Avenue – between Geary Blvd. and Euclid Avenue; Lot 032 in Assessor’s Block 1065 (District 2) - Request for Discretionary Review of Building Permit Application No. 2019.0410.7564 for construction of a new four-story, two-family dwelling on a vacant lot within the RH-2 (Residential-House, Two Family - Detached) Zoning District and 40-X Height and Bulk District.  The proposed building will be approximately 40 feet in height with two off-street parking spaces. One dwelling unit would occupy the habitable space behind the garage and the entire second floor. The second dwelling unit would occupy the entirety of the third and fourth floors. The project proposes a 430 square foot roof deck that is setback a minimum of five feet from all property lines. Second and fourth floor decks are proposed at the rear. This action constitutes the Approval Action for the project for the purposes of CEQA, pursuant to San Francisco Administrative Code Section 31.04(h). ). Persons who are unable to attend the scheduled Planning Commission hearing may submit written comments regarding these cases to the individuals listed for each case above at the Planning Department, 1650 Mission Street, 4th Floor, San Francisco, CA 94103. Comments received by 9:30 a.m. on the day of the hearing will be made a part of the official record and will be brought to the attention of the Planning Commission.

Pursuant to Government Code § 65009, if you challenge, in court, the approval of a conditional use, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the public hearing.
