Modification of an Approved Project Without Physical Changes (MOD)
In limited instances, for previously approved projects, a Project Sponsor may submit a request for Modification of an Approved Project form instead of a new application provided certain criteria are met. An approved project is one that has been finally approved by the Planning Commission or Department, and/or, the Project Sponsor has an issued Planning Approval Letter. This form does not apply to active projects seeking to change the scope midway through the development review process.
Types of Project Modifications
If your approved project only proposes non-physical changes, you may submit a Modification of an Approved Project request form. The following scopes are eligible:
- Inclusionary Rate Reduction Requests
- Removal of inclusionary requirements (only for projects proposing 24 or fewer units)
- Change in tenure (i.e. ownership to rental or rental to ownership)
- Modification of the elected method of compliance for the Inclusionary Housing Program
- Changes to State Density Bonus Projects (i.e. reduction to the applicable inclusionary fee or to waivers, concessions, and incentives)
- Extension of performance standards only
- Modification of previously conditioned hours of operation
- Variance for a project where the authorization is void and cancelled (i.e. not vested)
Any modifications to previously approved projects that exceed the above scopes must submit a new Project Application (PRJ).
